However we are NOT able to sell the The 50cc / 70cc ATV’S or Dirt Bikes- YET. The Consumer Product Safety Commission (CPSC) said today that its two commissioners had voted last Friday to hold off enforcing the lead content provision of certain components in kids' ATV, dirtbikes and snowmobiles for two years. The provisions were part of the Consumer Product Safety Improvement Act (CPSIA) passed last year. The ban on machines for youths 12 and younger became effective Feb. 10, 2009.
This means that the CPSC won’t enforce the ban on the sale of these machines and related parts, garments and accessories, although it’s unclear exactly what impact this action might have for powersports dealers who have not been selling the banned machines or for manufacturers that have stopped producing and selling kid’s machines. The ban still could be enforced by state attorney generals and other local officials.
Many dealers are selling kid’s machines that have been modified to meet the standard or that have been reclassified as being designed for kids aged 12 and older.
We are waiting for the smoke to clear on what we can do with the the 50 -70 cc category.) This vague law seems to have many interpretations and meanings that the powers that be can't seem to fully agree on. The bottom line is until the smoke clears and we have a true & hopefully logical set of rules & laws- We will be UNABLE TO SELL OR EVEN WORK on 50 & 70cc ATV'S. THIS NEW Administration has surprised the entire Power Sports Industry on these new interpretations that were meant for toddler’s toys, NOT ATV's! They have added draconian measures that make selling illegal drugs pale in comparison to ATV dealers that even dare sell a $10.00 part to a parent so they can at least fix their kids machine. ATV Dealers are THREATENED with heavy fines in the THOUSANDS and TENS OF THOUSANDS OF DOLLARS, AS WELL AS, PRISON if we break their rules that they themselves don't fully understand. Thus, dealers across the nation have been FORCED TO PULL the Children's ATV’S off the sale floor while waiting for those that "Know what is better for your children than YOU or anyone else does" to figure out what is going on. You can even read and sign Senator Tom Self of Missouri petition to the Product Safety Commission. By adding your signature to this petition and letting Your Voice be herd we can make a difference before ALL ATV's & DIRT BIKES ARE ILLEGAL. It has over 75,000 signatures.
